By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
2. Description of Service
QQQTrader provides AI-powered trade signal notifications for QQQ and TQQQ exchange-traded funds. The Service delivers trade signals and related market analysis via a web dashboard, email notifications, and optional SMS alerts. The frequency, timing, and nature of trade signals are determined by our proprietary models and are subject to change without notice.
3. Account Registration
- You must provide accurate and complete information when creating an account and keep it up to date.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You agree to notify us immediately of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
4. Subscription Plans & Billing
- The Service is offered on a paid subscription basis with monthly and annual billing options across multiple tiers (Basic, Premium, Professional).
- All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis at the then-current rate for your selected plan.
- Subscription fees are billed in advance for each billing period. Prices are listed in U.S. dollars (USD) and do not include applicable taxes, which will be added where required by law.
- We may offer promotional discounts or coupon codes from time to time. Promotional pricing applies only for the period stated and reverts to standard pricing upon renewal.
- We reserve the right to change subscription pricing at any time. Price changes will take effect at the start of your next billing cycle, and we will provide advance notice of any increase.
5. Free Trials
We may offer free trial periods for certain subscription plans. At the end of a free trial, your subscription will automatically convert to a paid subscription at the applicable rate unless you cancel before the trial expires. You may be required to provide a valid payment method to start a free trial.
6. Cancellation & Refunds
- You may cancel your subscription at any time through your account settings or by contacting us at support@qqqtrader.com.
- Upon cancellation, your subscription will remain active until the end of the current billing period. No prorated refunds are issued for unused portions of a billing period.
- Refunds may be issued at our sole discretion on a case-by-case basis. To request a refund, contact support@qqqtrader.com within 7 days of the charge.
7. Investment Disclaimer & No Financial Advice
THE SERVICE IS FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE INVESTMENT ADVICE, FINANCIAL ADVICE, TRADING ADVICE, OR ANY OTHER KIND OF PROFESSIONAL ADVICE.
- QQQTrader is not a registered investment advisor, broker-dealer, or financial planner. Trade signals generated by the Service are produced by automated models and are not personalized recommendations.
- Trading securities, including QQQ and TQQQ, involves substantial risk, including the potential loss of your entire investment. Leveraged ETFs such as TQQQ carry amplified risk and are not suitable for all investors.
- Past performance of the Service or its models does not guarantee future results. Historical signal accuracy is not indicative of future performance.
- You are solely responsible for your own investment decisions. You should consult with a qualified, licensed financial advisor before making any investment decisions based on information provided by the Service.
- We make no representations or warranties regarding the accuracy, completeness, or timeliness of any trade signals, market data, or other information provided through the Service.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QQQTRADER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Financial losses resulting from trades made based on signals or information provided by the Service.
- Loss of profits, data, goodwill, or other intangible losses.
- Service interruptions, delays, or errors in trade signal delivery.
- Unauthorized access to or alteration of your account or data.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Intellectual Property
All content, features, and functionality of the Service — including text, graphics, logos, software, trade signal algorithms, and data models — are owned by QQQTrader or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
11. Prohibited Conduct
You agree not to:
- Share, redistribute, or resell trade signals or any content from the Service to third parties.
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to reverse-engineer, decompile, or extract the source code or underlying models of the Service.
- Use automated tools (bots, scrapers) to access or interact with the Service without our express written permission.
- Interfere with or disrupt the integrity or performance of the Service.
- Create multiple accounts to exploit free trials or promotional offers.
12. Indemnification
You agree to indemnify, defend, and hold harmless QQQTrader, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your violation of these Terms, or your investment decisions.
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Texas. You agree to waive any right to a jury trial or to participate in a class action lawsuit.
14. Termination
We may suspend or terminate your access to the Service at any time and for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Any provisions of these Terms that by their nature should survive termination shall survive, including Sections 7, 8, 9, 10, 12, and 13.
15. Modifications to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date below and may notify you via email or through the Service. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and QQQTrader regarding the Service and supersede all prior agreements, understandings, and communications.
